What You Don’t Know CAN Hurt You! 

Ms. Evelyn Teague, Southeast Regional Director of the OFCCP 

Ms. Evelyn Teague is the Southeast Regional Director for the Office of Federal Contract Compliance Programs (OFCCP).  Ms. Teague has a wealth of experience in accounting, auditing and representing the legal interest of diverse entities in various industries including manufacturing, service, banking, construction, government, healthcare, entertainment and transportation.  Prior to joining the OFCCP in 2004, Ms. Teague served as in-house counsel representing management in labor and employment legal matters; she also served as a labor and employment director.   

Ms. Karen Garnett, Assistant District Director of the U.S. Department of Labor – Wage and Hour Division 

Assistant District Director Garnett has been with the Wage and Hour Division of the Department of Labor for 19 years.  Ms. Garnett ensures enforcement of a number of labor laws, including the Fair Labor Standards Act, Family and Medical Leave Act (FMLA), Wage Garnishment Law, Employee Polygraph Protection Act, Immigration and Nationality Act, Davis-Beacon and related Acts, Walsh-Healey Public Contracts Act and many others.  

Mr. Kenneth Brown, EEOC Senior Trial Attorney 

Mr. Kenneth Brown is the Senior Trial Attorney with the EEOC’s Louisville Area Office.  His practice concentrates on litigating claims under Title VII of the Civil Rights Act, the Equal Pay Act, the Americans with Disabilities Act and the Age Discrimination in Employment Act.  Mr. Brown is also an Adjunct Professor of Law at the University of Louisville’s Brandeis School of Law where he teaches Advanced Trial Practice.

We are excited to announce that Mr. Mickey Silberman, Esquire, Legal Counsel for the National Industry Liaison Group, will be our special guest speaker. 

Mickey Silberman is the Managing Partner of Jackson Lewis LLP’s Denver, Colorado office and is a member of the firm’s Affirmative Action Practice Group.  He represents management in all areas of employment law and specializes in EEO, affirmative action and diversity issues.  He has obtained Letters of Compliance in more than 99% of the hundreds of audits he has defended.  Moreover, of the past 100 audits he has defended, only two resulted in on-site visits by the OFCCP.  Mr. Silberman is also General Counsel to and serves on the Executive Committee of the National Industry Liaison Group Board.  He frequently meets with top OFCCP and EEOC officials to discuss the agencies’ regulatory initiatives and enforcement trends and presents the federal contractor community’s feedback on these developments.

KYILG SUMMER MEETING IS SCHEDULED

The meeting will be held at Masterson’s in Louisville.  Directions to Masterson’s will be forthcoming.

Mickey Silberman  will be speaking about the changes to the EEO-1 and VETS-100 reporting.  He will also address the OFCCPs recent clarification of the definition of an internet applicant.  This revised guidance will give employers additional direction and assistance in processing applications.  Mickey will further address hot topics regarding the OFCCP.

Kentucky ILG would like you to join us for a unique way to learn more about Alternative Dispute Resolution. 

Using a recent age discrimination case, take this opportunity to gain first-hand, interactive experience regarding mediation and arbitration techniques and the advantages of each versus litigation.  Several local distinguished attorneys will present the case using the different techniques. 

Sam DeShazer of Hall, Render, Killian, Heath & Lyman, PSC. will serve as the Mediator and Arbitrator.  Sam’s primary practice area is management employment relations and personnel law.  Sam serves on the arbitration and mediation panels of the American Arbitration Association (AAA), and on the mediation panel of ADR Vantage.  He has arbitrated and mediated numerous employment-related disputes, and was on the faculty and planning committees of the Institute for ADA Mediation.

 

Douglas Burchett, partner at Blackburn, Hundley & Domene, PLLC, will serve as counsel for the employer during our Alternative Dispute Resolution exercises.  Doug’s practice is dedicated to the representation of corporations and businesses of various sizes in a variety of litigation settings including claims for wrongful death, personal injury, defamation, discrimination, copyright/trademark infringement, and negligent hiring and supervision.  Doug also represents a local institution of higher learning in cases ranging from employment discrimination to HIPAA compliance.

Tracy Rigor, partner at Borowitz and Goldsmith PLC, will serve as Council for the employee.  Ms. Rigor represents clients in all phases of employment law and labor relations matters including litigation in state and federal court, discrimination and wrongful discharge litigation, collective bargaining negotiations, contract arbitration, and representation before various state and federal agencies.  Ms. Rigor also developed and presented in-house training in the areas of discrimination, harassment, EEO compliance and diversity issues.
